Abstract
The new statutory exception of use of copyright protected works at reading terminals in libraries ( 52b of the German Copyright Act, UrhG) causes many difficulties in its practical application. This article discusses what exactly is meant by the legal condition that the terminal must be located on the premises of the library. The conclusion is that the terminal can be located in any place where books of the library are stored for use. Furthermore the permitted use of the digitised work is analysed. A full-text search is allowed. It is also allowed to copy the displayed work digitally. To protect the publisher's interest, however, the digital copy is not allowed to be full-text researchable.
