User innovation networks can function entirely independently of manufacturers when (1) at least some users have sufficient incentive to innovate, (2) at least some users have an incentive to voluntarily reveal their innovations, and (3) diffusion of innovations by users is low cost and can compete with commercial production and distribution. When only the first two conditions hold, a pattern of user innovation and trial and improvement will occur within user networks, followed by commercial manufacturer and distribution of innovations that prove to be of general interest. Based on two surveys among the German software sector referring to the use and importance of IPR in the year 2000 and 2004, the analysis finds that the share of companies using patents in the software sector remains constant, but the relevance of this instrument increased significantly for the active users of patents. Based on a set of hypotheses on the determinants for the use of patents, we also find changes. The size bias of patent use increased, whereas there is a dichotomy between using patents and following the open source model in the software sector and not a convergence, as has been suggested by the anecdotal evidence of some large multinationals. We make an important distinction between initial developers those developers who decide what license will apply to the code they write, and later developers - those developers who subsequently wish to use code that was previously released under a certain OSL (and are therefore affected by license terms selected by initial developers). This distinction facilitates the analysis of the effect OSL provisions have on the development of new independent code and, importantly, their effect on any subsequent use of code released under an OSL. By comparing and contrasting the Linux model with the traditional/commercial model of software development and firm-based knowledge creation efforts, we show how the proposed model of knowledge creation expands beyond the boundary of the firm. Our model suggests that the product development process can be effectively organized as an evolutionary process of learning driven by criticism and error correction. For a variety of policy reasons, governments throughout the world are now adopting various legislative and administrative strategies that support the development of OSS. This article reveals some empirical data regarding the trend of evolving OSS policies globally. Additionally, this article investigates why so many governments are considering support of OSS development, and weighs the pros and cons of such policies. The ultimate conclusion is that when two systems are equally suitable, governments may reasonably choose OSS over proprietary software because software industry market failures may justify such support of OSS development. While governments considering supporting OSS are primarily concerned with significant switching costs and incompatibility problems, OSS is actually superior to proprietary software because it increases compatibility and consequently decreases switching costs in the long term. This software was developed over three decades and came into competition with a variety of open-source and proprietary alternatives. TeX was an early and very successful open-source project that imposed its standards in a particularly competitive environment and inspired many advances in the typesetting industry. While developers working under proprietary and open-source licenses responded to different sets of motivations, this did not mean they could abstract from each other&#039;s development decisions. The development of each type of software evolved in a symbiotic way. The strengths and weaknesses of both development methods were starkly revealed in the process. A pattern of semi-altruistic open-source development emerged, whereby developers considered non-developers&#039; needs in order to make TeX more attractive to a broader audience and more competitive vs. proprietary alternatives. Self-use motivations for development were complemented by direct and indirect network effect considerations. OS is a term for software published under licence that does not give any private intellectual property rights to the developers. They invest private resources in inventions that are then fed into a common pool by contributing to a public good. A look into history shows that OS isn&#039;t a unique example of an innovation model which Allen called &#039;collective invention&#039; (Allen 1983). In the second half of the nineteenth century iron-making companies in Britain&#039;s Cleveland district willingly shared their innovations in blast furnace design (Allen 1983). Other examples include the enhancement of steam engine design after 1800 (Nuvolari 2002) and the search for a dominant design in the flat panel display industry (Spencer 2003). Even though OS shares many similarities with these other cases of collective invention, there are two major differences. Firstly, collective invention regimes rarely seem to survive after the development of a dominant design (see e.g. Meyer 2002). In OS, this problem is solved with the institutional innovation of OS licences. Rather than just giving up their intellectual property rights, OS developers use these licenses to ensure that their innovations remain common property for all times (O&#039;Mahony 2003). Secondly, the problem of enforcing the rules of cooperation established in these licenses is solved in a rather informal, decentralised way. Enforcing the rules of cooperation establishes a public good of a second order (Elster 1989). In the Open Source context, the contribution to the second order public good can only be explained by the presence of a sufficient number of norm-based intrinsically motivated contributors who are willing to carry the private costs of rule enforcement. We show that the governance mechanisms used in OS projects are especially well suited not to crowd out this special kind of motivation. As commercial firms it is important to analyze how and why they are capable of drawing benefits from such involvement and their connected activities. Moreover, we want to stress the different types of business model these firms rely on and the possible evolution they are likely to follow in the near future. We shown how Open Source principles provide an alternative way of thinking and managing intellectual property that do not come up against the same problems but needs a radical change in the way of drawing commercial benefits from knowledge development tasks. Then we analyze the growing involvement of commercial actors by setting up a typology of the different business models that can be observed in the OS landscape, how they correspond to the different strategies of industrial firms according to the main characteristics of their technical skills and market position. This manifests itself in the ability of open source communities to encourage collaborative sharing of ideas and critical peer review. When these activities are important, the open source organizational form endogenously may do better than a proprietary organizational form. The desire to improve quality by circumventing such agency concerns may induce the founder of a software project to choose the open source form even though doing so foregoes potential profits, and this effect is magnified when there is an existing competing closed source project. However, most empirical analyses focus on individual developers and neglect firms that do business with Open Source software (Open Source firms). This paper contributes to the literature by providing empirical evidence on the incentives of firms that engage in Open Source activities. Data on firms&#039; motivations were collected by a large-scale survey conducted on 146 Italian companies supplying Open Source (OS) solutions and show that intrinsic, community-based incentives do play a role. Nevertheless, these positive attitudes towards the values of the OS community, which are quite surprising by profit-oriented firms, are not in general put into practise. Discrepancy between attitudes and behaviours is a widely investigated phenomenon in social psychology literature. We explore its pattern in our sample, find that it does not concern all the respondents, and single out a group of firms adopting a more consistent behaviour. Design patterns and pattern languages have recently emerged as a potential framework for addressing some of these challenges. However, the uptake of design patterns has been slow outside of the computer science community. We argue that this is largely a consequence of a weak positioning of pattern languages, as a form of delivering expert knowledge to layperson, and suggest an alternative view: the development of a pattern language as a community endeavour. In terms of open education, the workshop model can be viewed as an open production process for developing educational resources, in our case design patterns. We propose a model of pattern elicitation workshops, in which collaborative development of a pattern language provides a framework for sharing design knowledge within interdisciplinary communities. This model was iteratively developed at five international conferences. It was then postulated as a design pattern itself, encompassing a series of practices and a set of supporting tools.
