The book strives for as complete and dispassionate a description of the situation as possible and covers in detail: the substantive law applicable to euthanasia, physician-assisted suicide, withholding and withdrawing treatment, use of pain relief in potentially lethal doses, terminal sedation, and termination of life without a request (in particular in the case of newborn babies); the process of legal development that has led to the current state of the law; the system of legal control and its operation in practice; and, the results of empirical research concerning actual medical practice.

Soutenu par le PS, le PCF et une partie de l'UMP, le texte a été adopté en commission. Les uns y voient une avancée notable, les autres une cause d'inquiétude. La commission des affaires sociales du Sénat a adopté, mardi 18 janvier, une proposition de loi visant à instaurer « un droit à demander une assistance médicale pour mourir » pour les patients en phase terminale. La proposition de loi, qui sera discutée en séance le 25 janvier, a été adoptée par 25 voix contre 19 et 2 abstentions. C'est la première fois qu'un texte autorisant l'euthanasie franchit cette étape parlementaire.
Un médecin du centre hospitalier de la côte basque, à Bayonne (Pyrénées-Atlantiques), soupçonné d'euthanasie active sur au moins quatre patients âgés, a été placé en garde à vue mercredi au commissariat de cette ville. Les faits, qui concernent des décès survenus au cours des cinq derniers mois, dont celui d'une patiente âgée de 92 ans le 3 août, se seraient déroulés dans le service des urgences de l'hôpital. Une information préliminaire a été ouverte pour "homicide volontaire avec préméditation". Tous les cas signalés concernent des personnes âgées ayant été admises aux urgences tout en étant classées "en fin de vie", dans l'attente d'un placement dans un service de soins palliatifs, a-t-il encore indiqué. Les faits ont été signalés par des agents du service des urgences à leur hiérarchie, qui a pris la décision d'alerter la police, selon un communiqué diffusé jeudi par l'hôpital.
Sa mère est morte il y a six ans, mais Bernard Bruyère, 67 ans, ingénieur à la retraite, parle encore des conditions de son décès avec souffrance. En 2011, après l'affaire Bonnemaison (ce médecin soupçonné d'avoir provoqué la mort de patients), il avait écrit au courrier des lecteurs du Monde pour témoigner et s'insurger contre la loi Leonetti qu'il juge "inappropriée et indigne".
Il est normal qu'en période électorale les sujets de société s'invitent dans les programmes des candidats. Il est en revanche toujours regrettable que, sur ces sujets majeurs qui engagent notre vision des équilibres humains, les propositions mélangent le flou et l'improvisation. Cette situation est clairement dangereuse lorsqu'il s'agit de notre conception de la fin de vie et de la mort. M. Hollande propose que "toute personne majeure [en fin de vie] puisse demander, dans des conditions précises et strictes, à bénéficier d'une assistance médicalisée pour terminer sa fin de vie dans la dignité." Le Parti socialiste a évoqué "un pas vers l'euthanasie", bien que le terme ne soit pas mentionné. L'euthanasie signifie la possibilité ouverte de donner la mort à un malade qui le réclame. Est-ce cela que souhaite M. Hollande . Si c'est le cas, pourquoi, une fois de plus, ne pas le dire clairement ? "Un pas vers l'euthanasie", c'est l'euthanasie.
A l'heure où les candidats à l'élection présidentielle devront se positionner vis-à-vis du souhait de certains de légiférer sur l'euthanasie, je voudrais dire ceci : commencez par faire appliquer la loi qui existe ! Ensuite engagez une réflexion citoyenne autour des rares situations qui ne peuvent être résolues dans ce cadre. Nous sommes nombreux de tous bords à souhaiter que ces souffrances extrêmes puissent être soulagées au risque de transgresser la loi. Mais nous sommes conscients aussi de notre responsabilité vis-à-vis des plus vulnérables, ceux dont on décidera peut-être un jour que leur vie ne vaut pas la peine d'être vécue. Le code pénal, qui interdit au médecin de donner délibérément la mort, les protège. Une solution doit pouvoir être trouvée sans toucher à cet interdit de tuer qui structure notre société.
L'association pour le droit de mourir dans la dignité (ADMD), qui a déjà fait parler d'elle au début du mois de mars avec sa campagne de sensibilisation à l'euthanasie, a réuni entre 1 000 et 2 000 personnes, samedi 24 mars, sur la place de la République. Un rassemblement suivi d'une marche jusqu'au Cirque d'hiver où s'est organisé un meeting en présence notamment du maire socialiste de Paris, Bertrand Delanoë. Si l'association s'était contentée, il y a moins d'un mois, de photo-montages des candidats dans des lits d'hôpital, elle les a aujourd'hui appelés à venir s'exprimer publiquement sur la question de l'euthanasie.
A government-commissioned report released on Tuesday has recommended that France allow doctors to “accelerate death” for terminally-ill patients who want to end their lives. French people overwhelmingly support medically-assisted suicide, with an October poll showing 89% in favour. Examining the case for medically-assisted suicide was a campaign pledge made by French President François Hollande ahead of his election in May 2012. Hollande pledged to act on the recommendations of the government-commissioned report, which will be referred to a national council on medical ethics that will examine the precise circumstances under which doctors can assist in ending a patient’s life. Draft legislation could be produced in France as early as June 2013.
