Nun hat der Europäische Gerichtshof in einem Verfahren (Az. C-484/14) entschieden, dass Betreiber offener WLANs (auch in Einrichtungen wie etwa Cafés) zwar nicht haftbar gemacht werden können für Urheberrechtsverletzung durch User, dass aber Maßnahmen zur Verhinderung weiterer Rechtsverstöße angemessen und verhältnismäßig sein können.

Ziel des Gesetzentwurfes ist es, in Deutschland den Weg zu bereiten für mehr öffentliche WLAN-Hotspots. Der Gesetzentwurf lässt Fragen offen.
Die geplante Abschaffung der Mitstörerhaftung für die Betreiber offener WLAN-Angebote steht vor dem Scheitern. Vertreter der SPD-Fraktion machen hierfür die CDU/CSU-Fraktion im Bundestag verantwortlich.
Kaum einer der Experten war bei einer Anhörung des Bundestags zum geplanten WLAN-Gesetz ganz zufrieden mit dem Regierungsentwurf, am heftigsten wetterten aber ein Staatsanwalt und die Musikindustrie gegen die Initiative.
SPD und CDU haben beschlossen, das Telemediengesetzes zu ändern. WLAN-Betreiber müssen künftig nicht mehr befürchten, für illegales Nutzerverhalten zu haften.
