Abstract

This paper deals with the question of the justiciability of the principle of subsidiarity before the Court of Justice; it examines the position of subsidiarity in relation to the three conditions that, in Community law, must be fulfilled for an issue to be justiciable (the Court of Justice must have jurisdiction to deal with that issue, there must be a remedy whereby the issue may be brought before the Court, and the Court must have power to determine the substance of the issue); it reaches the conclusion that the principle of subsidiarity is justiciable but only up to a certain point and subject to restrictions arising from the limited nature of the Court's jurisdiction in cases involving judicial review.--SCAD summary.
