Es gibt eine neue Pest, die sich analog und digital schnell verbreitet. Man nennt sie „Allgemeine Geschäftsbedingungen“ (AGB). … Die Vertragswirklichkeit hat das Urheberrecht in eine Kapitulationserklärung verwandelt. Die Verwerter rauben den Urhebern alle Rechte. Gäbe es richtige Verträge, so könnten beide Seiten ihre Interessen einbringen, und keine Seite wäre „unangemessen benachteiligt“. Bei den AGB aber diktiert eine Seite die Bedingungen ganz allein.
Es kann der Frömmste nicht in Frieden verlinken, wenn es dem bösen Medienmogul nicht gefällt. Wenige Tage nach dem offiziellen Launch der Kommentar-Plattform Commentarist haben die Verlagshäuser SZ und FAZ dem kleinen Startup-Unternehmen durch Abmahnungen und Androhung „massiver rechtlicher Schritte“ den Stecker gezogen.
Bis heute haben die Verlage keinen Gesetzentwurf für das seit langem herbeigebettelte Leistungsschutzrecht vorgelegt. Wenigstens hierfür verdienen sie Dank. Ein Vortrag
Gestern zum Beispiel, als Keese auf der Veranstaltung „Wer verdient mit welchem Recht?“ in Hamburg eine besonders originelle (und mir neue) Begründung nannte, warum ein Leistungsschutzrecht für Verleger auch im Interesse der Urheber sei: Weil die Verleger, wenn sie erst einmal ein eigenes Recht hätten, aufhören könnten, den Autoren ihre Rechte wegzunehmen.
