The Dutch government wants to change copyright law so new media users can continue to do "creative remixes" of protected content. The Hague will no longer wait for the European Commission to find a compromise.
Wer glaubt, das 2004 veröffentlichte Urteil des Bundesfinanzhofs (BFH) mit dem Tenor „Anwendersoftwareentwicklung kann freiberuflich sein“ erleichtere die freiberufliche Anerkennung, irrt. Im Gegenteil: Die Finanzämter ebenso wie die Finanzgerichte verlangen umfangreiche Unterlagensammlungen als Nachweis der Freiberuflichkeit. Dem zu Folge sind u. a. Selbstdokumentationen, Wissensvergleiche, Tätigkeitsbeschreibungen, Bestätigungen, Referenzen und Arbeitsergebnisse vorzulegen. Dabei kommt es nicht nur auf die Ausbildung, sondern auch auf die Tätigkeitsinhalte und die ingenieurmäßige und ingenieurvergleichbare Vorgehensweise an. Seit 1987 sind durch die Finanzgerichte und den BFH zahlreiche Urteile ergangen, die sich aber teilweise widersprechen und beim Leser für Verwirrung sorgen. Umso mehr ist eine stringente Beweisführung erforderlich.
Seit etwa 150 Jahren wird die Debatte über das Urheberrecht von einer Leitidee bestimmt: Ohne Schutz kein Lohn. Autoren, das sind im Sinne des Urheberrechts vor allem Schriftsteller, Musiker und Künstler, könnten nicht überleben, wenn es erlaubt wäre, ihre Werke einfach zu kopieren. Autoren brauchen Rechte, um Einnahmen zu erzielen. Seither benutzen die Verwerter von Rechten, also Verlage, Produzenten und Medienunternehmen, den Topos des armen Künstlers, um Rechte in ihrem Sinne zu gestalten. Das Urheberrecht schützt aber die Verwerter, nicht die Urheber selb
