Die Bundesregierung will ab Mitte 2009 im Rahmen von E-Government 2.0 technische und rechtliche Rahmenbedingungen für eine "sichere und verbindliche elektronische Kommunikation" einführen. Grundpfeiler sollen Bürgerportale mit sogenannten De-Mail-Diensten sein, schreibt das IT-Magazin iX in Ausgabe 10/08.
Bei der sechsstündigen Anhörung zur Novelle des Gesetzes für das Bundeskriminalamt (BKA) am heutigen Montag im Bundestag waren sich Experten uneins, ob die geplante Ausforschung informationstechnischer Systeme grundrechtskonform durchführbar ist und ob die Ermittler dafür in Wohnungen eindringen dürfen sollten. Eine Lizenz zum Betreten der privaten vier Wände brächte laut BKA-Chef Jörg Ziercke "absolute Sicherheit", Zugriffe auf die Rechner Unverdächtiger auszuschließen. Sein Kollege vom bayerischen Landeskriminalamt, Peter Dahte, sprach sich mit ihm dafür aus, nach Vorbild der Regelungen für den "Bayerntrojaner" bundesweit zusätzlich zur "Fernbeeinflussung des Informationssystems" eine Manipulation vor Ort zu ermöglichen. Andernfalls würde das Kappen der Netzverbindung bei einer heimlichen Online-Durchsuchung bedeuten, dass die Polizisten "nicht mehr live mit drauf sind und damit blind werden".
Zwei Autofahrer wollen die Innenminister von Bayern und Niedersachsen per Klagen dazu zwingen, die Massenkontrollen von Kfz-Kennzeichen einzustellen. Das Gericht hatte im März die automatische Erfassung von Autofahrern in Hessen und Schleswig-Holstein für verfassungswidrig erklärt. Neben diesen beiden Ländern haben danach auch andere den Massenabgleich ausgesetzt, nur Bayern und Niedersachsen nicht. Dies wollen Oliver Steinkamp und Benjamin Erhart nun ändern lassen.
Angesichts des Datenmissbrauchs bei der Deutschen Telekom hat der Verein FoeBuD einen "Neustart" für den Datenschutz gefordert. "Das heißt, alles was bisher gesammelt wurde, muss gelöscht werden. Und Datenbanken dürfen nur mit ausdrücklicher Genehmigung wieder aufgebaut werden", sagte Vorstandsmitglied Rena Tangens der Frankfurter Rundschau. "Wir sollten uns ganz grundsätzlich klar machen: Sobald Datensammlungen da sind, ist auch immer das Potenzial gegeben, dass diese Daten missbraucht werden", betonte die Datenschützerin. Das liege an einem schwindenden Rechtsbewusstsein bei den Unternehmen.
Vor einem Jahrzehnt verfasste der Futurologe David Brin sein Sachbuch über die "transparente Gesellschaft". Experten stellten die Thesen des oft mit George Orwells "1984" verglichenen Werks rund um die digitale Durchsichtigkeit und das Ende der Privatsphäre nun während der Konferenz "Computers, Freedom, and Privacy 2008" (CFP) in New Haven (US-Bundesstaat Connecticut) auf den Prüfstand. Teils lobten sie dabei die Weitsicht des Autors, der den Versuch der Kontrolle personenbezogener Daten in der vernetzten Welt als Idee von gestern abtat und Privatheit als reine Geschmacksnote und soziale Erwartung charakterisiert hat. Teils warfen sie Brin aber auch eine Vermischung verschiedener Vorstellungen von Transparenz vor und verteidigten das Konzept des Datenschutzes.
