Auf der Münchner Sicherheitskonferenz ist die Idee eines Freihandelsabkommen zwischen den USA und der EU wieder aufgekommen, was restriktive Regelungen zum geistigen Eigentum bedeuten könnte.
Philippe Aigrain, Mitgründer der NGO La Quadrature du Net und Verfasser des Anfang des Jahres in englischer Sprache erschienenen Buchs “Sharing”, versucht nun mit 14 Thesen zu Urheberrecht und digitaler Kulturpolitik diese Debatte anzustoßen.
In drei Ausschüssen votierten die Abgeordneten am Donnerstag gegen das Anti-Piraterie-Abkommen. Die Voten im federführenden Handelsgremium sowie im Plenum stehen im Juni beziehungsweise Juli an.
50 Rechtsprofessoren haben den US-Senat darauf hingewiesen, dass das Anti-Piraterie-Abkommen ohne Zustimmung des Kongresses nicht in Kraft treten könne. In der EU kommt das Ratifizierungsverfahren nur schleppend in Gang.
Der Europäische Datenschutzbeauftragte sieht in ACTA die Gefahr "unakzeptabler Folgen für die Grundrechte". Der Grund: Das Anti-Produktpiraterie-Handelsabkommen definiert die angestrebten Maßnahmen nur mangelhaft.
Hannes Swoboda, Vorsitzender der sozialdemokratischen Fraktion im EU-Parlament, und der zuständige Berichterstatter David Martin plädieren dafür, das Anti-Piraterie-Abkommen zurückzuweisen. Die Einschätzung des EuGH solle nicht abgewartet werden.
ARD und ZDF gehören bekanntlich zu den Unterzeichnern eines Aufrufs an die Bundesregierung, das Anti-Piraterie-Abkommen ACTA »ohne weitere Verzögerung wie bereits beschlossen zu unterzeichnen«. Ich habe — ursprünglich für eine »Spiegel«-Geschichte, in der das dann aber keinen Platz fand — bei den Sendern nachgefragt, welche Konsequenzenes für sie hätte, wenn ACTA nicht unverzüglich und unverändert unterzeichnet würde.
Ob Netzneutralität, Datenschutz oder Urheberrecht – wie der digitale Raum reguliert werden sollte, ist höchst umstritten. Dazu kommt, dass viele Entscheidungen auf nationaler Ebene kaum sinnvoll getroffen werden können.
Handelskomissar Karel de Gucht und Michel Barnier (Binnenmarkt) treiben das umstrittene Abkommen voran. Die für „geistiges Eigentum“ zuständige Juristin der Kommission war bis 2004 Top-Lobbyistin der Musikindustrie.
Gesetzesvorlagen wie ACTA behaupten, sie wollten Urheber schützen, dabei geht es nur um antiquierte Geschäftsmodelle. Das erinnert stark an die „Locomotive Acts“ im Großbritannien des späten 19. Jahrhunderts – und könnte doch viel mehr Schaden anrichten.
