Nochmal ganz langsam zum Mitschreiben für den einen oder anderen europäischenn Gesetzgeber erklären Europas höchste Richter: Eine anlasslose Vorratsdatenspeicherung ist grundrechtswidrig.
Digitalcourage und der Arbeitskreis Vorratsdatenspeicherung ziehen mit fast 20 Mitbeschwerdeführern und 30.000 Unterstützern vors Bundesverfassungsgericht, um die Protokollierung von Nutzerspuren zu stoppen.
Mit einem Eilbeschluss hat der Bundesrat das Gesetzespaket befürwortet, mit dem der BND künftig Daten aus ganzen Telekommunikationsnetzen mit Auslandsverkehren auch im Inland komplett abschnorcheln darf.
Die EU-Kommission und die Mitgliedsländer haben offenbar keine Bedenken gegen den Anforderungskatalog der Bundesnetzagentur zur Umsetzung der Vorratsdatenspeicherung. Die strengen Auflagen können so bald in Kraft treten.
Verglichen mit den Erkenntnissen aus dem NSA-Untersuchungsausschuss fällt beim geplanten BND-Gesetz auf: Bislang illegale Aktivitäten und fragwürdige Rechtsauffassungen des BND sollen legalisiert werden – als wären Untersuchungsausschuss und verfassungsrechtliche Bedenken nie gewesen.
Der BND darf künftig Daten aus ganzen Telekommunikationsnetzen mit Auslandsverkehren auch im Inland komplett abschnorcheln, also etwa Netzknoten wie den Frankfurter De-Cix ausspähen. Der Bundestag hat dem nun zugestimmt.
Das Bundesverfassungsgericht sieht mit dem Protokollieren von Nutzerspuren allein noch "keinen derart schwerwiegenden Nachteil verbunden", der es rechtfertigen würde, das Gesetz vorläufig außer Kraft zu setzen.
In einem neuen Verfahren vor dem EuGH zur umstrittenen Vorratsdatenspeicherung hat sich der Generalanwalt nicht generell gegen eine Pflicht zur Datensammlung ausgesprochen. Er fordert aber enge Grenzen. Die Richter müssen dieser Einschätzung nicht folgen.
Deutsche Telekommunikationsfirmen befürworten eine Initiative der Bundesnetzagentur, mit der diese eine Art Outsourcing der Vorratsdatenspeicherung ins Spiel gebracht hat. Prinzipiell solle es möglich sein, das vollständige System zum Protokollieren von Nutzerspuren nebst Abfrageschnittstelle für Sicherheitsbehörden oder Einzelkomponenten davon an einen "Erfüllungsgehilfen" im Inland einschließlich der damit zusammenhängenden Aufgaben auszulagern, meint die Regulierungsbehörde.
Der BND soll das Netz umfassender ausspionieren und Daten aus ganzen Telekommunikationsnetzen mit Auslandsverkehren auch im Inland abschnorcheln dürfen. Einen entsprechenden Gesetzentwurf hat das Bundeskabinett befürwortet.
Dem früheren BND-Präsident Gerhard Schindler gehen die Pläne für neue Befugnisse des Auslandsgeheimdienstes nicht weit genug. Staatsrechtler machten bei einer Anhörung dagegen große Schwächen in dem Vorhaben aus.
Auf den islamistischen Faschismus, dessen Wirken wir in Europa gerade erleben, wissen Politik und Behörden nur eine Antwort. Und die ist falsch. Das lässt sich mit ein paar sehr klaren Zahlen belegen.
