Die Union drängt im Rahmen der Koalitionsverhandlungen auf die „Ausleitung“ des Datenverkehrs an „Netzknoten“ im Kampf gegen Terrorismus und schwere Verbrechen. Polizeien und Geheimdienste sollen Zugriff darauf haben.
Die Selbstbestimmung über Daten, die uns vorhersagbar machen, droht rasant beseitigt zu werden. Die Datenausbeutung durch Ökonomie und Geheimdienste kann die Politik nicht länger ignorieren.
Die Entscheidung des Bundesgerichtshofs (BGH) per Beschluss den urheberrechtlichen Auskunftsanspruch auch bei nicht-gewerbsmäßigen Rechtsverletzungen zuzuerkennen (vgl. Auskunftsanspruch auch bei nicht-gewerblicher Urheberrechtsverletzung) sorgt immer noch für heftige Diskussionen, vor allem unter Juristen.
„In der eingangs angesprochenen Tendenz der obersten Bundesgerichte, sich über den Gesetzgeber hinwegzusetzen, nimmt die aktuelle Entscheidung des I. Zivilsenats des BGH auf Anhieb einen Ehrenplatz ein. So kraß hat sie bisher noch kein Gericht praktiziert.“
